Liability Waiver and Code of Conduct click here if you cannot scroll the area CATHOLIC YOUNG ADULT SPORTS RELEASE, WAIVER OF LIABILITY, and ASSUMPTION OF RISK AGREEMENT: I hereby acknowledge and agree that in consideration of being permitted to participate in sports programs or activities organized, operated or sanctioned by the Catholic Young Adult Sports (hereinafter called "CYAS"): 1. I do hereby release CYAS, its members, officers, directors, employees, sponsors, the archdiocese of Denver, independent contractors, facilities and agents of and from all liability, and do hereby waive as against CYAS. Its members, officers, directors, employees, independent contractors, facilities and agents all recourses, proceedings, claims, actions and causes of action of any kind whatsoever, in respect of all personal injuries or property losses which I may suffer arising out of or connected with my preparation for, or participation in, the afore described sports programs or activities, notwithstanding that such injuries or losses may have been caused solely or partly by the negligence of CYAS, or any of its members, officers, directors, employees, independent contractors, facilities and agents, 2. And I hereby acknowledge and agree: a. that I am at least 18 years of age; b. that organized sports programs or activities can be very dangerous, exposing participants to many risks and hazards, some of which are inherent in the very nature of sports itself, others which result from human error and negligence on the part of the persons involved in preparing, organizing and staging sports programs and other activities; c. that, as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal injury, property loss, or even death; d. that some of the aforesaid risks and hazards are foreseeable, but others are not; e. that I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my preparation for, and participation in the aforesaid sports programs or activities shall be entirely at my own risk; f. that I understand that neither CYAS nor any of its members, officers, directors, employees, sponsors, the Archdiocese of Denver, independent contractors or agents assume any responsibility whatsoever for my safely during the course of my preparation for or participation in the aforesaid sports programs and activities; g. that I have carefully read this RELEASE, WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, that I fully understand same, and that I am freely and voluntarily executing same; h. that I understand clearly that by signing this release I will be forever prevented from suing or otherwise claiming against CYAS, its members, officers, directors, employees, sponsors, the Archdiocese of Denver, independent contractors, facilities and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in or preparing for any of the above mentioned sports programs or activities whether or not such loss or injury is caused solely or partly by the NEGLIGENCE of CYAS or any of its members, officers, directors, employees, independent contractors, facilities and agents; i. that I have been given the opportunity and have been encouraged to seek independent legal advice prior to signing this agreement; j. that I understand clearly that CYAS would not permit me to participate in any such sports programs and activities unless I signed the RELEASE, WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT applies to all the aforesaid sports programs or activities whether occurring in the near or distant future, and that the terms of this agreement need not be brought to my attention each time I participate in a sports program or activity in order to be effective; k. that the term sports programs or activities as used in this RELEASE, WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT includes without limiting the generality of that term, the programs, leagues, and activities as well as all other activities, training sessions, clinics, programs and events that are in any way authorized, sanctioned, organized or operated by either of CYAS or both of them; l. that this RELEASE, WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT is binding on myself, my heirs, my executors, administrators, personal representatives and assigns; m. I recognize that this release may be in addition to the release I must sign as a condition of participation or membership and that I am bound by the terms and conditions of both waivers; n. Photo & Video Release. I hereby grant Catholic Young Adult Sports (CYAS) and its photographers/videographers the right to use my likeness in any publication, including Internet entries and hardcopies, without payment or any other consideration. I understand and agree that any photographs/videos taken by CYAS are the copyrighted work of their photographers/videographers and may be altered, edited, copied, printed, published or distributed at their discretion or at the discretion of CYAS and its representatives. CYAS Code of Conduct-"Sportsmanship Contract" 1. Catholic Young Adult Sports, referred herein as CYAS, is a sports-based ministry independently serving the Archdiocese of Denver. 2. Participation in CYAS sports leagues emphasizes fun and Christian fellowship. 3. Each CYAS league encourages sportsmanship and safety. 4. CYAS leagues do not tolerate profanity, rowdiness, poor sportsmanship or dangerous play. Such behavior can warrant ejection from a game or match 5. The CYAS liaison or commissioner has the ultimate authority to eject a player from a game. Volunteer refs should first address the player and then the captain. If that does not work, the CYAS liaison or commissioner will be brought in to make the decision. 6. Any player or non-playing captain who is ejected from a game will be suspended for at least one following game. 7. Any player or non-playing captain who is ejected from a game a second time is subject to suspension for the remainder of the season. A committee appointed by the CYAS board will review the violations and determine the length of the suspension, including the possibility of it extending beyond the present CYAS season and into future CYAS seasons of all types. 8. A player or non-playing captain who has been ejected from a game can be asked to leave the premises by a referee/umpire/CYAS representative if the behavior continues to be a distraction. Failure to leave could result in forfeiture of game. Please be advised that spectators whom were invited by players and captains should adhere to 'good behavior" or they are subject to ejection from the premises as well. 9. Any physical attack during or following a play will result in immediate ejection from the game, the player will be asked to leave the premises at that time and will be subject to review by the CYAS Board for consideration of expulsion for the rest of the season or even the total elimination of future membership. 10. No player is allowed to participate in a game or match under the influence of alcohol or any other controlled substance, exceptions may be made for specific leagues or one-day events where it will be clearly stated in the rules or official posting from CYAS. In the event alcohol is allowed it will not be provided by CYAS. You waive your right to hold CYAS liable for any damages due to the consumption of alcohol and will be responsible for any liability and legal fees to CYAS from damages where you are found to be in negligence. ©2013 Catholic Young Adult Sports, a 501c3 non-profit corporation Last Revision 2-23-13
